K9 Scooper Heroes LLC – Terms of Service

1) Definitions
Account: A profile you create to access or manage the Service.
Add-On Services: Optional services (e.g., yard deodorizer, hose-downs, seasonal treatments).
Affiliate: Any entity that controls, is controlled by, or is under common control with the Company.
Company / we / us / our: K9 Scooper Heroes LLC.
Device: Any device used to access the Service.
Feedback: Ideas, suggestions, or proposals you submit to us.
Promotions: Special offers, discounts, contests, or free trials.
Service: Our website and our pet-waste removal and related offerings.
Subscriptions: Recurring paid plans for ongoing Service.
Third-Party Social Media Service: Non-Company services that may connect to our Service.
You / Client: The person or entity using the Service.
2) Acceptance & Eligibility
You must be at least 18 years old to use the Service. By accessing or using the Service, you agree to these Terms and our Privacy Policy.
3) Scope of Service
We scoop, bag, and haul away pet waste from accessible outdoor areas per your selected plan. We do not handle pets, enter homes/garages, or perform landscaping or property maintenance.
4) Scheduling, Routing & Time Windows
We optimize daily routes for efficiency and cost control; specific arrival times or time windows are not guaranteed.
Your service day stays consistent unless rescheduled for weather, holidays, safety, or operational needs.
If enabled in your Account, you’ll receive arrival and completion notifications.
5) Yard Access & Safety
You are responsible for providing safe, unobstructed access (e.g., unlocked gates, clear paths).
Locked gates, blocked paths, snow/ice build-up, overgrown grass, excess leaves/debris, or aggressive animals may result in a no-access visit that is charged and counts as a completed visit; see §7.
We will not climb fences, enter through homes/garages, or handle pets.
6) Service Area
Service is available only within our defined service area. We may refuse or cancel service outside this area.
7) Pauses, Skips, No-Access, Excess Waste & Seasonal Conditions
Pauses
Monthly plans: not eligible for pauses.
Weekly plans: if more than 14 consecutive days pass from the last service date, a $20 Initial/Reactivate Cleaning Fee applies when service resumes.
Every-other-week plans: if more than 21 consecutive days pass, a $20 Initial/Reactivate Cleaning Fee applies.
Billing During Pauses: Subscriptions remain prepaid month-to-month and billing continues during a pause unless you cancel per §29. Pauses are for scheduling only, not billing holidays.
Homeowner maintenance during a pause does not waive the fee if thresholds are exceeded.
Skips (Client-Requested)
Request window: Skips must be requested in writing at least 24 hours before your service day (email support@k9scooperheroes.com or SMS text to our published business number; include your name and service address).
Skipped visits remain billable under prepaid monthly billing; no refunds or credits are issued.
Catch-Up: We will resume on your next scheduled service day and remove both the skipped and current accumulation in one visit at no additional charge beyond your prepaid plan. If the accumulation exceeds normal for your plan, the Excess Waste Surcharge may apply.
Late requests (<24 hours): may not be accommodated. If our technician has been dispatched or arrives, the visit will be treated as a no-access/late-cancellation and charged as a completed visit.
No-Access Visits (Company-Attempted)
If our technician arrives but cannot access the service area (e.g., locked gate, blocked path, snow/ice, overgrown grass, aggressive animals, unsafe conditions), the attempt is recorded as a no-access visit.
No-access visits are charged and count as a completed visit due to the time, gas, and other expenses incurred to travel to the property. We will document the attempt (e.g., time-stamped photo or notes).
We do not return the same day for no-access situations. Service continues on your next scheduled service day. Any extra accumulation may be subject to the Excess Waste Surcharge.
Seasonal Conditions – Snow & Leaves
Snow/Ice: We do not shovel or de-ice. If snow or ice prevents safe access or substantially hides waste, the visit will be rescheduled or recorded as no-access (see above). During light snow where access is safe, we perform a best-effort cleanup but cannot guarantee removal of waste concealed under snow/ice. Hidden waste may be collected at the next service.
Leaves/Debris: We do not rake, bag, or haul leaves as part of base service. When leaf cover is light to moderate, we perform a best-effort cleanup of visible waste. When leaf cover is heavy and prevents a thorough cleanup, we may (a) reschedule, or (b) complete a visible-only cleanup and note that hidden waste may be missed.
Client Preparation: To ensure a thorough visit, please clear snow/ice from gates and paths and keep leaf depth to a serviceable level on your service day.
Excess Waste Surcharge
If the volume of pet waste or on-site conditions add more than 20% additional cleanup time beyond the normal plan visit (e.g., extended gaps, added dogs, pet boarding, heavy leaf cover, prior no-access), a surcharge of $10–$35 may apply. We’ll note it on your invoice and can provide time-stamped documentation on request.
8) Holidays & Weather
Service may be rescheduled due to nationally recognized holidays, extreme weather, or unsafe conditions. We will notify you of changes with at least 48 hours’ notice when feasible.
Weather reschedules are prioritized to your same route day the following week or the closest available route day; we’ll notify you as early as possible.
9) Add-On Services
Add-Ons (e.g., deodorizer) are not included in base plans and must be purchased separately. Details and pricing will appear in your plan selection and/or invoice.
10) Service Documentation
We may document service (e.g., time-stamped photos, GPS logs, gate photos) for quality assurance, training, and billing verification.
For no-access or limited-visibility conditions (snow/leaves), we may capture time-stamped photos and notes for your records.
11) Pricing, Billing & Payment
Estimates & On-Site Assessment
Online, phone, and advertised prices are estimates for standard yard sizes and typical accumulation.
Estimates do not include Add-On Services, larger or irregular areas, excess accumulation, trip surcharges (if applicable), or taxes.
A K9 Scooper Heroes technician may perform an on-site assessment on or before your first visit to confirm scope and pricing. If conditions require a change, we will issue a final quote before service begins. You may accept the updated quote or cancel prior to service commencement (see §29).
Prepaid Monthly Billing (Recurring Plans)
All recurring Subscriptions are prepaid monthly and billed on the 1st of each month for services scheduled during that month.
Service begins or continues only after successful payment is received for the month.
If the 1st falls on a weekend or holiday, the charge may process the next business day.
Proration & Mid-Month Changes
New signups mid-month: first invoice is prorated from your service start date through the last day of that month based on the number of scheduled visits in that period.
Plan upgrades or added dogs mid-month: we may charge a prorated amount immediately for the remainder of the month.
Plan downgrades or removals mid-month: take effect on the next month’s invoice.
Existing promotional discounts (if any) apply only to future, not past, charges.
One-Time Cleanups
One-time cleanups must be paid in full in advance at booking. Appointments are confirmed after payment is received.
Payment Authorization
By enrolling in recurring service, you authorize automatic charges to the payment method on file on the 1st of each month. If a payment attempt fails, our system will retry up to 3 times. If payment is not received, service may be paused until resolved.
Payment Methods
We accept major credit/debit cards (e.g., Visa, MasterCard, American Express) and may offer additional approved electronic methods (e.g., PayPal). Cash or check is accepted only if paid in full in advance for the entire billed period.
Refunds, Credits & Adjustments
No refunds for prepaid monthly charges or services already performed.
If we must cancel service for reasons within our control and cannot reasonably reschedule within the same billing period, we may issue an account credit at our discretion.
We may adjust, reschedule, or refuse service due to unpaid invoices, excessive pet waste, aggressive dogs, overgrown grass, excessive lawn debris, inaccessible yards, or extreme weather conditions. Client-caused skips or no-access visits do not qualify for credits or refunds.
12) Promotions, Discounts & Free Trials
Canceling or allowing a subscription to auto-renew does not qualify you for new or current promotions.
Pausing a subscription does not re-qualify you for promotions.
Promotions may include their own terms that supersede these Terms where they conflict.
Promotional discounts apply to future prepaid invoices and are not retroactive unless expressly stated.
For prorated first months, percentage-based discounts apply to the prorated amount.
Free trials (if offered) may require valid billing information and will auto-renew into a paid plan unless canceled before the trial ends.
13) Communications Consent (Texts & Email)
By signing up, you agree to receive service, scheduling, and billing communications via SMS and email. Message frequency varies. Msg & data rates may apply. You may opt out of texts at any time by replying STOP; you may opt out of emails via the unsubscribe link. Opting out may limit our ability to provide timely notifications.
14) User Accounts
You must keep Account information accurate and secure and notify us of any unauthorized use. Do not use someone else’s name, offensive language, or third-party trademarks in usernames.
15) Intellectual Property
All content on the Service is owned by us or our licensors and protected by applicable intellectual-property laws. You may not use our marks or content without written permission.
16) Feedback
If you submit Feedback, you grant us a non-exclusive, perpetual, irrevocable, royalty-free, worldwide license to use, modify, and distribute it without restriction.
17) External Links
Third-party sites linked through our Service are not controlled by us. Review their terms and privacy policies; we are not responsible for their content or practices.
18) Property Damage
We are not responsible for incidental damage to landscaping, irrigation systems, lawn ornaments, outdoor equipment, or other property unless caused by our gross negligence.
19) Pet Handling
We do not handle or restrain pets. You must secure pets prior to service. We are not liable for pets that escape due to faulty gates, broken latches, or owner error during our visit.
20) Right to Refuse Service
We may modify, refuse, or discontinue service if conditions are unsanitary, unsafe, outside our scope, or for other reasonable operational or safety concerns.
21) Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, RELIABILITY, OR ERROR-FREE OPERATION.
22) Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM OR (B) $100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (E.G., LOST PROFITS OR DATA).
23) Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles.
24) Dispute Resolution – Informal First
Contact us first to attempt to resolve any dispute informally before taking legal action. Nothing here prevents you from seeking relief in small-claims court where applicable.
25) U.S. Legal Compliance
You represent that you are not located in a country embargoed by the U.S. government and are not on any U.S. government list of prohibited or restricted parties.
26) Severability & Waiver
If any provision is found invalid, the rest remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later.
27) Changes to These Terms
We may update these Terms at any time. For material changes, we’ll provide 30 days’ notice by posting on our website and/or contacting you. Your continued use of the Service after changes take effect constitutes acceptance.
28) Privacy & Data Use
We do not sell your personal information. We use your contact and billing details only for communication, scheduling, and secure payment processing, as described in our Privacy Policy.
29) Cancellation & Termination (Prepaid Plans)
How cancellations work under prepaid monthly billing
Recurring Subscriptions are prepaid monthly and billed on the 1st for that month’s services. You may cancel at any time by written notice, through the client portal, by email to support@k9scooperheroes.com, or by SMS text to our published business number.
Cancellations take effect at the end of the current prepaid month. There are no refunds or credits for the remainder of a month that has already been billed.
To avoid the next month’s charge, submit your cancellation in writing before 11:59 PM local time on the last day of the month. Requests received on or after the 1st will apply after the end of that month.
No refunds once dispatched or cleaned
There are no refunds for yards cleaned or for service attempts once a technician is dispatched, including no-access visits where we arrive but cannot access the area. No-access visits are charged and count as completed due to the time, gas, and other expenses required to travel to the property.
One-time cleanups
One-time cleanups are prepaid and non-refundable once scheduled.
Company termination
We may suspend or terminate your Account for violations of these Terms, unsafe or unsanitary conditions, or nonpayment. Service may resume at our discretion after issues are resolved (reactivation fees may apply; see §7).
30) Subscription Duration & Auto-Renew
Subscriptions continue month-to-month until canceled. Billing occurs automatically unless you provide written notice of cancellation.
31) Testimonials & Reviews
By submitting a review or testimonial, you grant us permission to use it in marketing or promotional materials, including our website and social media.
